These Terms of Use ("Terms") govern your access to and use of the image-generation tools and related services (the "Service") provided by Story Co ("we," "us," or "our"). By uploading images to, or generating images with, the Service, you agree to these Terms. If you do not agree, do not use the Service.
You are solely responsible for any image, photograph, logo, artwork, text, or other material you upload or submit to the Service ("Your Content"). You represent and warrant that:
You grant us a limited, non-exclusive license to host, process, transmit, and modify Your Content solely to operate and provide the Service to you.
Images produced by the Service ("Outputs") are generated by third-party artificial-intelligence models. As between you and us, you may use the Outputs for your own commercial and non-commercial purposes, subject to these Terms. You are responsible for reviewing every Output before you use it, including for accuracy, suitability, and compliance with any third-party rights and applicable laws. AI-generated Outputs may not be eligible for copyright protection, and similar Outputs may be generated for other users.
You agree not to use the Service to create, upload, or distribute content that is illegal, infringing, harmful, harassing, deceptive, or that impersonates any brand or person without authorization, or to attempt to reproduce branded or trademarked packaging you do not have the right to use.
You agree to defend, indemnify, and hold harmless Story Co and its owners, employees, and contractors from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) Your Content, (b) your use of the Service or any Output, or (c) your breach of these Terms or of any third-party right. This obligation survives termination of your use of the Service.
The Service and all Outputs are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any Output will be accurate, appropriate for your use, or free of third-party rights.
To the maximum extent permitted by law, Story Co will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service or any Output. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the amount you paid us for the Service in the three (3) months preceding the event giving rise to the claim.
We may update these Terms from time to time. Your continued use of the Service after any change constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
